The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code.

As per prosecution case, when the informant was returning after collection of cash, in the meantime, six miscreants on Pulsor bike and Hero HF Delux bike, intercepted the informant and on the point of pistol, snatched his bag containing his mobile phone, cash of Rs.49,980, PAN card, Aadhar Card, Driving Licence, ATM Cards and other documents and thereafter they fled away.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He

No.60317 of 2021(2) dt.13-05-2022 2/2 further submits that on the basis of the confessional statement of co-accused, Dinesh Sahni, the name of the petitioner has transpired in this case. He further submits that nothing has been recovered from the conscious or constructive possession of the petitioner and petitioner has not been arrested at the spot. Petitioner has got clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Ms. Arti Kumari, Judicial Magistrate, Ist Class, Muzaffarpur (East)/concerned Court in connection with Katra P.S. Case No. 211 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
