JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 24-02-2016 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Gurua Police Station Case No. 158 of 2015, disclosing offences under Sections 147, 149, 341, 323, 324, 307, 379, 504 and 427 of the Indian Penal Code. Prior to the institution of the present case, mother of petitioner nos. 4 and 5 got instituted a First Information Report on 11.09.2015, being Gurua Police Station Case No. 156 of 2015.

It is the contention on behalf of the petitioner

Patna High Court Cr.Misc. No.6069 of 2016 (2) dt.24-02-2016 2/3 that the present case has been instituted in retaliation of the earlier case, instituted on 11.09.2015. He further submits that the allegation is of causing injuries by lathi/khanti. There is no specific allegation of assault against these petitioners.

Considering the nature of accusation, genesis of the occurrence and the background of the case, this application is allowed.

Let the petitioners, Satish Singh, Chitranjan Kumar @ Chit Ranjan Kumar, Shatrunjay Kumar, Manish Kumar, Jitya Nand Kumar and Sanjay Kumar @ Sanju Kumar, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sherghati, Gaya, in connection with Gurua Police Station Case No. 158 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the same may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond

Patna High Court Cr.Misc. No.6069 of 2016 (2) dt.24-02-2016 3/3 shall be liable to be cancelled.
