JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-05-2023 The limited prayer made in the present writ petition is to direct the Circle Officer, Kesaria, District- East Champaran i.e. the respondent no. 5 to dispose off the pending Encroachment case no. 03 of 2021-22, within a stipulated time frame.
The learned counsel for the respondent- State submits that in case, the encroachment proceedings are still pending, the same shall definitely be disposed off within a stipulated time frame, as fixed by this Court.
Having regard to the limited prayer made in the present writ petition, I deem it fit and appropriate to direct the
Patna High Court CWJC No.13026 of 2022(2) dt.08-05-2023 2/2 respondent no. 5 to dispose off the aforesaid pending Encroachment case no. 03 of 2021-22, in case the same has not already been disposed off, by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, in accordance with law and after hearing the affected parties, within a period of six weeks of receipt/ production of a copy of this order.
The writ petition stands disposed off on the aforesaid terms.
