ANJANA MISHRA ORAL ORDER 05-02-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

Diary in the present case was called for, which has since been received.

The petitioner is in custody since 30.06.2015 in connection with Bisfi P.S. Case No. 199 of 2014, registered for offences punishable under Sections 341, 323, 324, 327, 307, 400, 504 read with Section 34 of the Indian Penal Code, under Section 25(1-AA), 27 of the Arms Act and under Section 63 and 4 of the Explosive Substance Act.

Learned counsel for the petitioner submits that though there is an allegation that the petitioner was present at the place of occurrence and is alleged to have hurled the bomb, the injury

It is further submitted that in paragraph 194 of the case diary, it appears that the injury sustained was of a hard blunt substance and not out of any explosion as alleged in the F.I.R.

Considering the aforementioned facts and circumstances and that, admittedly, the informant was not the eyewitness and also that the petitioner has been languishing in jail since 30.06.2015, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additonal District and Sessions Judge, Madhubani in connection with Bisfi P.S. Case No. 199 of 2014.
