1. Heard learned counsel for the petitioner and learned A.P.P. Mr. Chandra Bhushan Prasad for the State.
2. The learned APP Mr. Chandra Bhushan Prasad has filed show-cause on behalf of the Superintendent of Police, Nalanda and the Investigating Officer of the case. It is also submitted that the benefit of Section 41(A) of the Cr.P.C. was given to the petitioner though little belatedly.
3. The learned counsel appearing on behalf of the petitioner does not dispute the said submission of the learned APP that benefit of Section 41(A) of the Cr.P.C. was given to the petitioner but belatedly. The learned counsel for the petitioner further submits that charge sheet has already been
Patna High Court OR. CR. MISC No.1 of 2024(3) dt.09-08-2024 2/2 submitted against the petitioner.
4. Since the benefit of Section 41(A) of the Cr.P.C. was given to the petitioner and the same is not being disputed by the learned counsel appearing on behalf of the petitioner, as such, the Court is not inclined to proceed with the contempt application.
5. The contempt application is dismissed.
