The petitioner seeks bail in connection with NDPS Case No. 01 of 2025 arising out of Bachhwara P.S. Case No. 07 of 2025 instituted for the offences under Sections 8, 20(b)(ii)(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 3.
This is the second attempt of the petitioner for bail. The petitioner has renewed his prayer for grant of regular bail which was earlier rejected on merit by this Court vide order dated 28.01.2026, passed in Cr. Misc. No. 69851 of 2025, taking into account quantity of contraband more than commercial quantity and there is bar under Section 37 of the NDPS Act. 4.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.50991 of 2026(2) dt.24-07-2026 2/3 petitioner is languishing in judicial custody since 07.01.2025 without any rhymes or reason, having no criminal antecedent. It is submitted that one (1) out of six (6) charge sheet witnesses have been examined in this case. Learned counsel for the petitioner submits that there is no likelihood of the trial being concluded in the near future, hence, petitioner may be enlarged on bail.

Learned APP for the State opposes the prayer for grant of bail.

There is no new ground to consider the bail petition of the petitioner. From the aforesaid report, it appears that the trial is going on.

In view of the above, the prayer for bail of the petitioner is again rejected with a direction to the court below to expedite the trial and conclude the same expeditiously. 9.
The District Magistrate, Begusarai and the Superintendent of Police, Begusarai are also directed to take necessary steps to produce the witnesses on the date fixed in the Trial Court so that the trial could be concluded within the stipulated period.
