JUSTICE ARVIND SRIVASTAVA ORAL ORDER 19-05-2023 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant. The petitioner apprehends his arrest in connection with Basopatti P.S. Case No. 223 of 2021 registered under Sections 498A, 34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that petitioner is a labour and earns about Rs.8,000/- per month and he is ready to pay Rs.4,000 (Rupees Four Thousand) per month to the opposite no. 2/wife as her interim maintenance. Patna High Court CR. MISC. No.50369 of 2022(7) dt.19-05-2023 2/2 thereof, a supplementary affidavit has been filed. The petitioner has got no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Judicial Magistrate-I, Madhubani in connection with Basopatti P.S.
