JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419,420,467,468,471,472 and 120B/34 of the Indian Penal Code. The prosecution case is that the informant and other police officials raided the house of one Devan Lal. On search, several forged and fabricated certificates of the University and other Board Offices were recovered from the area of house of Devan Lal where Bachu Mishra was residing as a tenant. Said Bachu Mishra disclosed the name of others including the petitioner being the then Block Education Extension Officer, Bisfi. It is submitted by the learned counsel for the petitioner that there is no recover from the petitioner and now the petitioner
Patna High Court Cr.Misc. No.6191 of 2016 (2) dt.09-02-2016 2/2 has retired on 6.2.2013. Till date charge sheet has only been submitted against Bachu Mishra whereas investigation is pending against the petitioner. Statement to that effect has been made in paragraph 8 of the petition.
Considering the fact that petitioner is a retired public servant and thrust of accusation is against co accused Bachu Mishra, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Pupri at Sitamarhi in connection with Pupri P.S. Case No.161 of 2009 subject to the conditions as laid down under Section 438(2) Cr.P.C. The learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner defaults without any reasonable cause on three consecutive occasions.
