The petitioner seeks bail in connection with Baruraj P.S. Case No. 51 of 2019, registered under Sections 341, 323, 504, 498(A) and 494 of the Indian Penal Code. The accusation is that the marriage of informant Rubi Kumari was performed with the petitioner in the year 2016 and, thereafter, she went to her matrimonial house, but she was not liked by her husband (Petitioner) and she was being threatened to perform his remarriage, while informant stayed at her matrimonial house about one year and six months, but her husband (Petitioner) performed his

Patna High Court CR. MISC. No.48198 of 2019(6) dt.18-12-2019 2/2 remarriage, when she made protest then she was removed from her matrimonial house causing assault to her. Learned counsel for the petitioner submits that petitioner is the husband of informant and on the consent of the informant, the petitioner performed his remarriage. Further submission is that while notice, as issued to the informant/O.P No.2, was received by her brother, but in spite of receiving of notice, she has not appeared in this case. The petitioner is in custody since 08.03.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M. 1st Class, Muzaffarpur in connection with Baruraj P.S. Case No. 51 of 2019.
