Learned counsel appearing on behalf of the petitioner submitted that the transfer of the petitioner, who has been transferred from the office of the Sub- Divisional Agricultural Officer, Bhabhua, Kaimur to the office of the SubDivisional Agricultural Officer, Barh, Patna vide Memo No. 1159 dated 29.06.2024, is inconsistence with the Government's decision and, as such, the same calls for interference. Learned

Patna High Court CWJC No.11496 of 2024(2) dt.05-08-2024 2/2 counsel further submitted that the decision of the Government is specific and transfer of employee generally takes place after completion of three years on one place and the same having not been done, the petitioner seeks to file a detailed representation before the Director, Department of Agriculture, Bihar, PatnaRespondent No. 2.

The Director, Department of Agriculture, Bihar, Patna- Respondent No. 2, is directed to consider the grievance of the petitioner and see, as to whether, the order of transfer of the petitioner is penal in nature then, certainly, the same is required to be rectified by him. The representation, if any filed by the petitioner, is also required to be considered and disposed of in accordance with law.

4. With above observation/direction, the present writ petition is disposed of.
