JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504, 506, 34 of the Indian Penal Code.
The prosecution case is that in the background of land dispute, co-accused Jamil Yadav assaulted with iron rod to the informant when this petitioner caused injury with dagger near the eye of the informant. It is submitted by learned counsel for the petitioner that the injury has been found to be simple and coaccused have been granted anticipatory bail by learned Court below.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the nature of injury, there being no accusation of repeating the blow and petitioner having no
Patna High Court Cr.Misc. No.7271 of 2016 (2) dt.18-02-2016 2/2 criminal antecedent, it is a case for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Singhwara P.S. Case No. 192 of 2015, pending in the Court of learned Chief Judicial Magistrate, Darbhanga.
With the observations above, the application stands disposed off.
