Some silver ornaments are said to have been recovered from conscious possession of the petitioner, while petitioner was found sitting in A/C coach of a train and, thereafter, the present case was registered for the offences punishable under Sections414, 467, 468, 471, 420 & 120B of the Indian Penal Code. Submission on behalf of the petitioner is that police after due investigation, submitted final form but the learned court below differed with the findings of the police and took cognizance against the petitioner. It is further pointed out that having similar allegation, one co-accused, namely, Rakesh Roshan Srivastava has already been granted privilege of bail.
