JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and two others were caught by the police while traveling in a train and in huge quantity gold and silver ornaments were recovered from their conscious possessions. The contention on behalf of the petitioner is that petitioner is a goldsmith and as a matter of fact, he had purchased seized articles but unfortunately, police arrested the petitioner on mere suspicion and after due investigation, police submitted final form showing the case as mistake of fact but learned court below deferred with the findings of the police and took cognizance of the offences.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.2232 of 2016 (2) dt.25-01-2016 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Khagaria in connection with Rail Mansi P.S.case No. 12 of 2015.
