2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 103, 238, 3(5) of the Bharatiya Nyaya Sanhita.

3. As per prosecution case, all the F.I.R. named accused persons, including these petitioners, armed with deadly weapons, entered the house of informant and assaulted her husband by tying Gamcha around his neck as a result of which, he died on the spot. Informant is eye witness of the occurrence.

4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. Allegation of assault is general and omnibus. As a matter of fact, deceased was suffering from liver psychosis and on the alleged date of occurrence, deceased died due to the heated conversation that took place between informant and deceased. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application and submitted that informant claims to be eye witnesses of the occurrence and as per F.I.R. these petitioners committed murder of the deceased.

6. Considering the nature of accusation and gravity of the offence, prayer for anticipatory bail of the petitioners is refused.
