JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 27.11.2015 in a case registered for the offences punishable under Sections 20,21,22 and 25 of the NDPS Act.
From the house of the petitioner 10-12 ganja plants and one and half kilograms of semi prepared ganja were recovered. It is submitted by the learned counsel for the petitioner that from the FIR itself it appears that none were present in the house as the petitioner used to reside at Nasik since long and recovery has been made from his native place. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. More over, similarly situated co accused Shambhu Singh, Bambam Singh and Sarbada Singh alias Sarbada
Patna High Court Cr.Misc. No.57961 of 2015 (2) dt.04-01-2016 2/2 Nandan Singh have been granted bail vide Cr. Misc. No. 56548 of 2015.
Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Munger in connection with Kharagpur P.S. Case No. 10B of 2013.
The bail bonds of the petitioner will be accepted on filing of an affidavit by the petitioner before the learned court below that he will regularly cooperate in the investigation. The said affidavit will be transmitted by the learned court below to the concerned I.O. Non cooperation in the investigation or default during trial will give liberty to the prosecution to file application before the learned court below to cancel bail bonds of the petitioner.
