JUSTICE RAKESH KUMAR ORAL ORDER 07-05-2018 Heard Sri Rana Pratap Singh, learned counsel for the petitioner. None appeared on behalf of the State whereas, Sri Ranjan Kumar Jha, learned counsel for informant is present. The sole petitioner, who is in custody, in connection with Kahalgaon (Rasalpur) P.S. Case No. 557 of 2017, registered for the offence under Sections 147, 148, 149, 447, 342, 302 of the Indian Penal Code , 1860 and Section 27 of the Arms Act, 1959, has prayed for grant of bail. Learned counsel for the petitioner submits that only accusation against the petitioner is that he along with others in the occurrence also fired but it caused injury to one Lalan Paswan. It has been argued that Lalan Paswan has not supported the prosecution case. However, on going through the impugned

Patna High Court Cr.Misc. No.26924 of 2018(2) dt.07-05-2018 2/2 order it appears that only on 13.03.2018 charges have already been framed. Meaning thereby, that trial has commenced. Since trial has commenced , there is no reason to entertain the prayer for bail.

The petition stands dismissed.
