The applicant/accused in Crime No. 39 of 2018 registered with Yadopur Police Station for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, by this application is seeking his release on bail during pendency of the trial.

Heard the learned counsel appearing for the applicant/accused as well as learned APP appearing for the State.

The applicant along with his brother was found in possession of 267 bottles each containing 180 ml Indian made foreign liquor.

No.59943 of 2021(3) dt.30-03-2022 2/2 Though, investigation of the subject crime is over, the applicant, it seems is repeating commission of similar offences while on bail in earlier offences. Offences of similar nature are registered against him right from the year 2018. He is also an accused in the offences relating to human body. The accused can be released on bail only when the Court is satisfied that he will not repeat similar offence in future. Such is not the case in hand. Accordingly, the application stands rejected.

The applicant to remove all office objections forthwith and the Registry to issue the certified copy of this order only after removal of office objections by the applicant/accused.
