JUSTICE ANIL KUMAR SINHA ORAL ORDER 12-08-2021 Heard Mr. Ram Vinay Prasad Singh, learned counsel for the petitioner and Mr. Mukund Mohan Jha, learned A.C. to Govt. Pleader-27 for the State through video conferencing. The petitioner has filed the present writ application for a direction to the respondent no. 2 to pay ex-gratia of Rs. 4 Lacs to the petitioner as per government resolution dated 08.09.2015. The further claim of the petitioner is for directing the respondent concerned to pay the salary due for four months.

Patna High Court CWJC No.3615 of 2021(2) dt.12-08-2021 2/3 The petitioner is the husband of deceased Prakhand Teacher, who died in harness while working in Upgraded Middle School - Rampur, under Block- Sikandra, District - Jamui on 12.05.2015.

Learned counsel for the petitioner submits that as per Government resolution annexed at Annexure- "5" to the writ petition dated 08.09.2015, ex-gratia payment of Rs. 4 Lacs shall be paid in case Panchayat / Prakhand teacher dies in harness. Learned counsel next submits that petitioner has filed a detailed representation before the respondent no. -2 i.e. District Education Officer, Jamui and the same may be directed to be disposed of by the concerned respondent.

Learned counsel for the State has got no objection if such direction is issued by the Court.

Having heard learned counsel for the parties, this writ application is disposed of with a direction to the respondent no. - 2 / District Education Officer, Jamui to consider the grievance of the petitioner raised in his representation at Annexure - "7" to the writ petition and to dispose the same in accordance with law by a reasoned and speaking order within a period of two months from the date of receipt / production of a copy of this order. Needless to say that if any amount is found payable to
