JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-03-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Triveniganj P.S. Case No. 44 of 2020, registered for the offence punishable under Section 392 of the Indian Penal Code.

As per the FIR, co-accused Om Prakash along with three others riding on motorcycle intercepted the informant and on the point of pistol snatched Scooty, print machine and wi-fi and fled away.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of investigation, name of this petitioner has come in this case on the basis of confessional statement of co-accused Rajit Kumar @ Laltu Ram. No looted article has been recovered from possession of this petitioner. No test identification parade has

Patna High Court CR. MISC. No.60362 of 2021(3) dt.25-03-2022 2/2 been held till date. It is submitted that although petitioner is accused in four other criminal cases but in all those cases he is on bail. Petitioner is in custody since 27.03.2021 and investigation in this case is complete .

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Supaul in connection with Triveniganj P.S. Case No. 44 of 2020.
