2. The present writ petition has been filed for setting aside the order dated 06.03.2024 contained in Letter no. P.Eight1/2023-(78) passed by the DIG, CRPF, Yelahanka, Bengaluru, Karnataka (annexed as Annexure-P/3) by which the petitioner has been dismissed from the service and further prayer has been made to re-instate the petitioner.

3. Learned counsel for the Union of India raised preliminary objection and submits that the order of dismissal is

Patna High Court CWJC No.12244 of 2024(2) dt.22-08-2024 2/2 Annexure-P/3 and in Annexure-P/3, it has been categorically mentioned in paragraph no.27 that the petitioner if aggrieved by the said decision, may prefer appeal under Rule 28 of Central Reserve Police Force Rule 1955.

4. It transpires from Annexure-P/6 of the writ petition that the appeal is still pending and no decision has been taken yet. And as such, Union of India submits that a direction may be given to The Inspector General of Police (C.R.P.F.) K.K. Sector, Central Reserve Police Force, Bengaluru, Karnataka to pass order on appeal filed before him under Rule 28 of Central Reserve Police Force Rule 1955.

5. Accordingly, the present writ petition stands disposed off directing The Inspector General of Police (C.R.P.F.) K.K. Sector, Central Reserve Police Force, Bengaluru, Karnataka (respondent no.3) to pass a reasoned and speaking order on the appeal filed by the petitioner within 90 days from the date of production of the order.
