The petitioner is in custody in connection with Aurangabad (Town) P.S. Case No. 94 of 2018, a case under Sections 147, 148, 149, 504, 436, 427, 307, 160, 295(A), 353 of the Indian Penal Code.
Allegation in brief is that on the occasion of Ramnavmi procession, a communal riot broken out and both sides raised slogan against each other and threw brick bating. Submission is that a large number of people have been made accused however no specific overt act is alleged against anyone including the petitioner and he has no criminal antecedent
Patna High Court Cr.Misc. No.29030 of 2018 (2) dt.14-05-2018 2/2 except a case lodged for the same occurrence against him and is in custody since 27.03.2018.
Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Aurangabad (Town) Police Station Case No. 94 of 2018 with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
