JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-02-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,307 and 504/34 of the Indian Penal Code. The prosecution case is that on 28.9.2015 at 8 A.M. the petitioner nos. 1,2, and 3 were standing on the door when the informant was passing through their door when on the order of petitioner no. 5 Md. Rizwan Ansari, accused persons assaulted the informant. Petitioner nos. 1, 2 and 3 are alleged to have assaulted with garasa and khanti. The informant's wife was assaulted by petitioner no. 4 and co accused Furkan Ansari and Ali Ansari also
Patna High Court Cr.Misc. No.8565 of 2016 (2) dt.23-02-2016 2/2 made assault.
It is submitted by the learned counsel for the petitioners that the injury of the informant and his wife have been found to be simple. Both have received one injury each though the accusation of assault is by several persons. There is counter version of the occurrence where the petitioners side received grievous injury also. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Sherghati, Gaya in connection with Dumaria P.S. Case No.58 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
