The petitioner is languishing in custody for the offences punishable under Sections 302/201/34 of the Indian Penal Code.

Petitioner is father of the husband of the victim. The victim died after nine years of her marriage. There is no eyewitness of the occurrence.

Submission is that presumption of dowry death is not there and there is no eyewitness of the occurrence of murder. Considering the aforesaid facts coupled with the fact that petitioner is in custody since 13.12.2017, who is aged about 80 years, and investigation of the case is complete, let the

Patna High Court Cr.Misc. No.27485 of 2018 (2) dt.07-05-2018 P2/ petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Vaishali P.S. Case No.186 of 2011, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
