Heard the learned counsel for the petitioner and learned APP for the State.
The petitioner apprehends his arrest for the offences alleged under Sections 341, 323, 494, 498(A), 504, 506 and 120(B) of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act, registered in connection with Sabour P.S.Case No. 281 of 2021.
The learned counsel for the petitioner has submitted that it is a matrimonial dispute and the petitioner is nandosi (brother-in-law) of the informant having no concern with day-
Patna High Court CR. MISC. No.51287 of 2022(2) dt.19-01-2023 2/2 to-day affairs of the couple. The mother-in-law of the informant has been granted anticipatory bail by this Court in Cr.Misc. No. 49883 of 2022.
Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur in connection with Sabour P.S.Case No. 281 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.
Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
