Petitioner is named in the first information report but there is specific allegation against the petitioner that he along with Jot Narain Sahani assaulted the injured by means of lathi and prior to that the aforesaid injured was assaulted by Tribhuwan Sahani by means of iron rod. Photostat copy of the injury report of injured has been annexed as annexure 2 to this petition and the aforesaid injury report goes to show that only one injury was found on the person of injured Jogi Sahani. So far as deceased Ram Sahai Sahani is concerned, he was assaulted by other accused. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sadar,
