This application for grant of anticipatory bail arises out of Forbisganj (Simraha) P.S. Case No. 126/2015, disclosing offences under sections 341, 323, 325, 326, 379, 427, 504, 34 of the Indian penal Code read with section 3(1)(iv)(v)(x) of the SC/ST Act. Only for the reason that on the basis of the allegations, as contained in the First Information Report, offence under the provisions of the Scheduled Caste & Scheduled Tribe (Prevention of Atrocities) Act is made out, in view of statutory bar, this application for anticipatory bail cannot be entertained. It is submitted on behalf of the petitioner that he has been made accused only because he is lawyer for the other co-accused
Patna High Court Cr.Misc. No.7531 of 2016 (2) dt.16-03-2016 persons in a case in which the informant is a party. This application is, accordingly, disposed of with an observation that if the petitioner appears before the court below within six weeks from today and applies for regular bail, his application shall be disposed of on the same day.
