The petitioner is languishing in custody for the offence under Sections 147,148,149,302/34 of the Indian Penal Code. Submission is that co-accused Jitan Yadav having identical allegation, has been allowed bail vide order at Annexure-2 by coordinate Bench of this Court mainly for the reason that allegation was against all the FIR named accused persons to have entered into the house of informant armed with knife, Barcha and Tangi and assaulted the wife of the informant as a result of which she died. Doctor has opined in the postmortem report that single injury was found on the person of the deceased.
Considering the aforesaid fact, let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below
Patna High Court CR. MISC. No.46717 of 2019(2) dt.29-07-2019 2/2 where the case is pending in connection with Dumaria P.S. Case No. 45 of 2018, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court below having immovable property in his name.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) khushbu/- U T
