2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Beldour P.S. Case No. 346 of 2024 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.

3. The case of the prosecution is that the petitioner along with others were going on a bike with illegal liquor. As they saw the police, they managed to escape throwing the sack containing illicit liquor. It is further alleged that 20 liters of the illicit liquor was recovered from the sack.

4. Learned counsel for the petitioner has submitted that no seizure has been made from the possession of the

Patna High Court CR. MISC. No.48680 of 2025(2) dt.05-08-2025 2/2 petitioner. He is having no criminal antecedent. From perusal of the seizure list it transpires that the seizure was made near a Peepal tree which is an open place.

5. Learned APP for the State has vehemently opposed the bail application.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Beldaur P.S. Case No. 346 of 2024, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge-II, Khagaria, subject to the conditions as laid down under Section 482(2) of the BNSS.

7. Accordingly, the present bail application stand allowed.
