This application for grant of anticipatory bail arises out of Pakarridayal P.S. Case No. 77/2015, disclosing offences under sections 272/273 and 290 of the Indian penal Code, Sections 47/47A of the Bihar Excise Act and section 39 of the Wild Life Protection Act and sections 33 and 52 of the Indian Forest Act. Learned counsel for the petitioner appears to be right in his submission that similarly circumstanced other co-accused persons have been granted anticipatory bail vide order dated 2.12.2015 passed in Cr.Misc.No. 54458/2015.

Considering the above submission, this application is

Patna High Court Cr.Misc. No.7515 of 2016 (2) dt.16-03-2016 allowed.

Let the petitioner, abovenamed, in the event of his arrest/ surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Prahlad Kumar, Judicial Magistrate, 1st Class, Sadar, Motihari, East Champaran in Pakarridayal P.S.Case No. 77/2015, subject to the conditions as laid down under section 438(2) of the Cr.P.C.

This is subject to the condition that the petitioner shall present himself before the police/ court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
