The petitioners apprehend arrest in connection with Masaurhi P.S. Case No. 315 of 2021 Spl. Case No. 4109 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

Submission of learned counsel for the petitioners is that petitioners are innocent and have falsely been implicated in the present case due to village politics. There is general and omnibus allegation against the petitioners. Further he submits that petitioners have no criminal antecedent. Learned A.P.P. appearing on behalf of the State

Patna High Court CR. MISC. No.59898 of 2021(2) dt.15-04-2022 2/2 opposed the prayer of the petitioners by contending that petitioners are named in the first information report. The alleged recovery has been made from the hut of the petitioners. Hence, the petitioners do not deserve to be enlarged on anticipatory bail.

Having considered the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, prayer of the petitioners is rejected. shailendra/- (Arvind Srivastava, J) U T
