2. The present writ application has been filed for the following reliefs:- "(i) For issuance of an appropriate writ the nature

Patna High Court CWJC No.10134 of 2026(2) dt.14-07-2026 2/3 of certiorari for quashing the part order dated 8-62026 as contained in Memo No.-3806(E), dated 8-62026 whereby and whereunder respondent No.- 8 has also been selected as successful Bidder along with the petitioner though there in no change in any type of circumstances after passing the earlier order dated 20-5-2026 as contained in Memo No.-881, dated 21-5-2026 whereby only petitioner was declared successful Bidder made by Technical Bidder Evaluation Committee meeting held on 19-52026.

(ii) For issuance of an appropriate writ in the nature of MANDAMUS commanding and directing the respondent authorities to permit the petitioner only to discharge its duty only to work for working and strenthening of old alignment of Purnea Katihar Road (NH-131-A) from (i)Delha Chowk IOCI Petrol Pump (Ch.-62.11KM yo 63.01 kM) and (ii) Dalan Chowk to Kushwaha Chowk (Ch. 47.35 Km to 60.45 Km) Total length - 74.00KM for the year 2025-26.

Considering the nature of the relief sought for in the present writ application, without expressing any opinion on the merits of the case, this Court deems it appropriate to grant liberty to the petitioner to file a detailed representation before the Engineer-in-Chief, Road Construction Department, Government of Bihar, Patna (Respondent No. 4).

4. In case, if such representation is filed before the Respondent No. 4, Respondent No. 4 shall consider the same and pass an appropriate order in accordance with law, after affording an adequate opportunity of hearing to the petitioner and all other stakeholders.

5. With the aforesaid observation, the writ application stands disposed of.

6. Pending application (s), if any, shall stand disposed of.
