The petitioner seeks bail in Halsi P.S. Case No. 47 of 2018 corresponding to Sessions Trial No. 137 of 2018, registered for the offences punishable under Section 302/34 of the Indian Penal Code.
It is submitted by learned counsel appearing on behalf of petitioner that petitioner is innocent. Petitioner has falsely been implicated in this case due to village politics. Petitioner is in custody since 24.05.2018 having no criminal antecedent. Considering the facts aforesaid and the fact that there is specific allegation of assault against this petitioner by spade (Kulhari) upon the deceased, I am not inclined to enlarge the petitioner above-named on bail in connection with Halsi P.S. Case No. 47 of 2018 corresponding to Sessions Trial No. 137
Patna High Court CR. MISC. No.46712 of 2019(3) dt.25-09-2019 2/2 of 2018. Accordingly, the same is rejected.
The trial court is directed to conclude the trial preferably within nine months from the date of receipt of this order.
