The petitioners seek bail in connection with Chakai P.S. Case no. 8 of 2018 registered under Sections 273/34 of the IPC and Section 30(a) of Bihar Prohibition & Excise Act-2016. 27 lts. of country made liquor is said to have been recovered from the joint possession of the petitioners during course of checking of the vehicle.

It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from conscious physical possession of the petitioners. They have no concern with the seized liquor. They have been falsely implicated in the

Patna High Court Cr.Misc. No.18689 of 2018(2) dt.26-04-2018 2/2 case by the police merely due to altercation with the police over displaying the photostat copy of the documents of the vehicle by the petitioners. They have no criminal antecedent. They have been languishing in custody since 29.01.2018. In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge, Jamui in connection with Chakai P.S. Case no. 8 of 2018.
