The petitioner has filed the instant application for grant of regular bail in connection with Mansi P.S. Case No. 273 of 2019 registered under Sections 147, 148, 149, 341, 307, 302, 120(B), 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

Prosecution case as per FIR is that while the informant and his brother along with other persons were making election campaign for the purpose of PACS Chairman in favour of the candidate, Abdul Salam, in the meantime, all the 14 named accused persons surrounded them and started abusing Further, co-accused Manoj Yadav fired at the brother of the informant hitting him on his chest and thereafter, this petitioner

When informant's brother tried to escape but other co-accused persons also fired causing injury to him thereafter he was taken to hospital where doctor declared him dead. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. There was a scuffle regarding election campaign between the parties due to which he has falsely been implicated in this present case. As per statement of injured witness, general allegation against the petitioner rather specific allegation of firing is against coaccused Manoj Yadav, who fired on the chest of the deceased. Moreover, similarly situated several co-accused persons have already been granted bail by different coordinate bench of this court. The petitioner is languishing in judicial custody since 31.5.2022.

The application for bail is vehemently opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail.
