JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the informant and even if, prosecution story is assumed to be true, then also, entire allegation of committing rape is against the co-accused and moreover, having more or less similar allegation some co-accused have already been granted privilege of bail.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champara in connection with Shikarpur P.S.Case No. 196 of 2014.
