The petitioner seeks bail in Murliganj P.S. Case No. 66 of 2018 registered under Section 30 (a) & 37 (b) of the Bihar Prohibition and Excise Act, 2016.
15 liters of country made liquor is said to have been recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has been falsely implicated in this case by planting the aforesaid recovery at the instance of his enemy. He has no concern with the seized liquor. He has no criminal antecedent and has been languishing in
Patna High Court Cr.Misc. No.23158 of 2018 (02) dt.26-04-2018 2/ 2 custody since 01.03.2018.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S. Case No.66 of 2018.
