JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 03-08-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 342 and 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Prosecution case is that the accused persons surrounded the son of the informant and co-accused Mahesh Mahto shot fire resulting death of the son of the informant. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that specific allegation of shot fire is against coaccused Mahesh Mahto and not against this petitioner. Petitioner
Patna High Court CR. MISC. No. 59975 of 2021(3) dt.03-08-2022 2/2 is not named in the FIR. Postmortem report shows that there is only one injury and cause of death is gun shot on the head of the deceased. Petitioner has clean antecedent. Learned APP appearing for the State opposed the anticipatory bail.
Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Samastipur in connection with Patori P.S.
