The petitioner has preferred this application for grant of regular bail in a case registered under sections 8 and 20 of the Narcotics Drugs and Psychotropic Substances Act, 1985. As per the prosecution case, on a raid being conducted 45 kgs of ganja is stated to have been recovered from the residence of Khokha Singh who is said to be the man of coaccused Surendra Singh.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. At the outset it is submitted that neither the petitioner is Khokha Singh nor any incriminating article has been recovered from his possession or his house. The petitioner has no concern either

Patna High Court CR. MISC. No.7842 of 2021(12) dt.20-12-2021 2/2 with the accused Khokha Singh or with the coaccused Surendra Singh. An old man aged about 65 years has been falsely implicated in a case of the year 2002 much belatedly. The petitioner is in custody since 14.10.2020.

The application for bail is opposed by learned counsel for the Narcotics Control Bureau who submits that witnesses will be examined at the earliest. He further submits that all the witnesses on behalf of the prosecution shall be examined within a period of two months from today. A report was called for from the learned trial Court. As per the report received contained in letter dated 9.10.2021 of the Additional District and Sessions Judge 4th, Bhojpur, Ara, it is stated that attempt will be made to conclude the trial within a period of 2 months and that the Narcotics Control Bureau has been directed to produce their witnesses.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the Court is not inclined to enlarge the petitioner on bail and the application is rejected. The Narcotics Control Bureau is directed to produce their witnesses within a period of two months from today in the trial. Learned trial Court is directed to expedite the trial and conclude the same within three months.
