1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in connection with Bind P.S. Case No. 145 of 2023 registered for the offence punishable under Sections 341, 323, 354, 307, 379, 504/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is an accused of assaulting the injured with spade causing multiple contusion.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and the petitioner and one co-accused are alleged to have assaulted the victim but only one injury has been found The petitioner is in custody since 04.06.2024.

5. Learned counsel for the informant opposes the prayer for regular bail and submitted that the petitioner is the assailant of the victim, trial has started and out of five witnesses, one witness has already been examined.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, I am not inclined to grant bail to the petitioner. This application is dismissed.
