The petitioner, Imtiyaz Nurani @ Md. Imtayaj Nurani, who apprehends his arrest in Bisfi (Patauna) P.S. Case No.12 of 2006 registered for the offences punishable under Section 406, 409 of the I.P.C.

It appears that F.I.R. was lodged by the informant alleging that this petitioner who was ex. Chairman of 'PACS' defaulted Rs.2 lakhs which was given to him for construction of godown. The learned counsel for the petitioner submitted that in fact the godown has already been constructed and subsequently, meeting was held and the godown has already been handed over to 'PACS'. The report to this effect has already been submitted by

On the other hand, the learned A.P.P. objected the prayer for bail.

Considering the above facts and circumstances of the case that the godown has already been constructed and it has been handed over to the concerned authority, I direct the petitioner, in the event of his arrest / surrender within one month from today to the Court concerned, shall be released on bail on furnishing bail bonds of Rs.5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Madhubani in connection with Bisfi (Patauna) P.S. Case No.12 of 2006, subject to condition as laid down under Section 438 (2) of the Cr.P.C (Mungeshwar Sahoo, J) Sanjeev/- U
