2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 30(a), 41(1) and 41(2) of the Bihar Prohibition and Excise Act, 2016, registered in connection with Ujiarpur P.S.Case No. 321 of 2023.

3. As per allegation, the police party were informed about involvement of the petitioner and his son in trade of illicit liquor. They swung into action and rushed to the place of occurrence and total 604 litres of liquor recovered from near their house.

4. The learned counsel for the petitioner has

No.53076 of 2024(2) dt.02-08-2024 2/2 submitted that there is allegation of storage of illicit liquor against some of the accused persons and this petitioner has been implicated merely because he is the father of co-accused Mukesh Kumar, who has been granted anticipatory bail by a coordinate Bench of this Court under order dated 29.11.2023 passed in Cr.Misc. No. 76184 of 2023. It is further submitted that the petitioner is the person of clean antecedents.

Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise-1, Samastipur in connection with Ujiarpur P.S.Case No. 321 of 2023, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
