Petitioners apprehend arrest in a case registered for the offence punishable under Sections 341, 323, 308, 506, 34 of the IPC.

As per the prosecution case, allegation against these petitioners is of commission of assault by lathi on the head of the informant. It is further alleged that all the accused persons including the petitioners also assaulted the son and grand son of the informant.

It is submitted on behalf of the petitioner that due to dispute with respect to pathway, altercation took place in which both sides sustained injury. Case and counter case. Injuries sustained by the injured are simple in nature. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the

Patna High Court CR. MISC. No.50113 of 2022(2) dt.15-12-2022 2/2 prayer for bail.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sri Aditya Kumar Sharma 1st class Magistrate, Bikramganj (Rohtas) in connection with Rajpur P.S. Case No. 04 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
