2. The petitioners apprehend their arrest in connection with Nautan P.S. Case No. 142 of 2026 dated 08.05.2026 registered for the alleged offences under Section 30(a) of Bihar Prohibition and Excise Act, 2022.
3. Prosecution story in brief, is that the informant got a secret information that Lallu Rajbhar and Sanjay Chauhan @ Chhotu Chauhan are going to carry illegal liquor. The Police reached the spot and saw two individuals carrying plastic sacks.
Patna High Court CR. MISC. No.49971 of 2026(2) dt.22-07-2026 2/3 Upon seeing the Police, taking advantage of the bushes they managed to escape after leaving the bike. During the search, a total quantity of 54 litres of illegal liquor was recovered by the Police.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case due to mere suspicion. The counsel further submits that the both the petitioners have one criminal antecedent and have committed no offence as alleged in this case.
5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioners.
6. Having heard the parties and considering the fact that the petitioners have been named in the FIR due to mere suspicion. I am inclined to grant the petitioners benefit of anticipatory bail. Let the petitioners above named, in the event of arrest/surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court is connection with Nautan P.S. Case No. 142 of 2026 dated 08.05.2026 subject to the conditions as laid down under Section 482(2) of the Bhartiya
