This application for grant of regular bail arises out of K.Nagar P.S. case No. 457 of 2019, disclosing offences punishable under Sections 392 and 365 of the Indian Penal Code.
The petitioner had earlier approached this Court for grant of regular bail, which was rejected by an order dated 05.06.2020 passed in Cr. Misc. No. 818 of 2020. The petitioner is in custody since 14.11.2019. The informant's Pick-up Van was intercepted by the miscreants and after tying his hand and legs, the vehicle and another articles were looted by unidentified criminals. The petitioner was not named in the First Information Report and his name transpired
Patna High Court CR. MISC. No.7103 of 2021(2) dt.17-02-2021 2/3 on the basis of confessional statement of co-accused Md. Alam. Taking into account the materials collected during the course of investigation available in the case diary to the effect that the confessional statement of Md. Alam led to recovery of articles, his prayer for regular bail was rejected.
The petitioner has renewed his prayer for bail by making the present application, in view of the subsequent developments.
Learned counsel for the petitioner informs this Court that Md. Alam on the basis of whose confessional statement petitioner has been made accused, has been allowed regular bail by a co-ordinate Bench of this Court by an order dated 08.01.2021 passed in Cr. Misc. No. 31227 of 2020. Further one Suraj Kumar has also been granted regular bail by an order dated 04.12.2020 passed in Cr. Misc. No. 26494 of 2020. Considering the submission that some of the coaccused persons have been allowed regular bail by this Court, this application is allowed.
Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in K. Nagar P.S. Case No. 457
