2. In the present case, the petitioner seeks bail in connection with Darbhanga Rail (G.R.P.) P.S. Case No. 154 of 2024 registered for the offences under Sections 303(2), 317(4), 317(5), 317(2) of the B.N.S.

3. As per prosecution case, petitioner was found in possession of stolen mobile phones.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nothing incriminating has been recovered from the person or possession of this petitioner. Seizure list has not been prepared following the procedure prescribed under the law. Charge has already been framed

Patna High Court CR. MISC. No.52017 of 2025(2) dt.12-08-2025 2/3 against the petitioner on 02.04.2025 and he is in custody since 23.09.2024. Petitioner is having antecedent of 8 cases and he is on bail in all these cases. Charge-sheet has been submitted.

5. Learned A.P.P. opposes the submission made on behalf of the petitioner. Learned APP submits that petitioner appears to be habitual offender.

6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner and submission of chargesheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge1st, Samastipur/concerned court in connection with Darbhanga Rail (G.R.P.) P.S. Case No. 154 of 2024, subject to the conditions mentioned in Section 480(3) of the B.N.S.S. and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.
