ANJANA MISHRA ORAL ORDER 05-02-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are custody since 01.07.2015 in connection with a case registered for the offences punishable under Sections 302/341/323/324/307/447 and 34 of the Indian Penal Code. Diary in this case was called for earlier which has since been received.
Learned counsel for the petitioners submits that there is general and omnibus allegation against all the accused persons of having assaulted the deceased. It is submitted that the informant being the eldest son of the petitioners' husband had been nursing
Patna High Court Cr.Misc. No.142 of 2016 (3) dt.05-02-2016 P2/2 animosity against his step-mother, the petitioner, and therefore, the allegation has been made against her. It is submitted that no specific role has been assigned to her that she attacked the deceased in a particular manner.
Learned counsel for the State after perusal of the case diary submits that save and except general and omnibus allegations, there is no specific act attributed to the petitioners. Considering the aforementioned facts and circumstances of the case and the period of custody, let the petitioners abovenamed be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Katihar in connection with Azamnagar P.S.
