The petitioner seeks bail in connection with Sheohar P.S. Case no. 53 of 2018 registered under Sections 30(A) and 37(A)(D) of Bihar Prohibition & Excise Act-2016. 40 lts. of toddy is said to have been recovered from a hut and four accused persons including the petitioner were apprehended consuming the same.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has no concern either with the toddy or with the hut in question. He had never consumed any toddy. He has been falsely implicated in the case
Patna High Court Cr.Misc. No.26802 of 2018(2) dt.03-05-2018 2/2 at the instance of his enemy. He has no criminal antecedent. He has been languishing in custody since 28.03.2018. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Addl. Sessions Judge-cum-Special Judge, Sheohar in connection with Sheohar P.S. Case no. 53 of 2018. (Prakash Chandra Jaiswal, J) rohit/- U T
