The petitioners are in custody since 06.09.2015 for having violated the earlier order of bail granted in his favour in connection with Sessions Trial No. 260(A) of 2012 Trial No. 832 of 2015 arising out of Akilpur P.S. Case No. 15 of 2011 for the offence registered under Sections 147, 148, 149, 342, 302 and 423 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that till commitment of the case, he was appearing regularly in the court below and after commitment of the case, he had gone to Punjab and thereafter, in his absence, his Parwikar could not appear due to some unavoidable situation.

Considering the aforesaid submissions, let the

Patna High Court Cr.Misc. No.107 of 2016 (33) dt.05-02-2016 petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions JudgeVth Danapur (Patna) in connection with Sessions Trial No. 260(A)/2012, Trial No. 832 of 2015 arising out of Akilpur P.S. Case No. 15 of 2011.

However, it is made clear that if the petitioner does not appear in the court below on two consecutive dates without any reason whatsoever, it shall be open for the Court Below to pass appropriate order in accordance with law including the cancellation of bail order passed by this Court.
