The petitioners have renewed their prayer for anticipatory bail in a case registered for the offences punishable under Sections 406, 420, 467, 468, 471/34 of the Indian Penal Code and 47(a) of the Excise Act. The prosecution case is that during patrolling the informant being police officer received information that country made liquor is being sold illegally, raid was laid when two persons were seen carrying liquor on motorcycle without registration number but seeing the police party the accused persons escaped from the scene leaving the
Patna High Court Cr.Misc. No.7316 of 2016 (2) dt.27-07-2016 motorcycle and chowkidar suggested the name of the petitioners. It is submitted by learned counsel for the petitioners that only on suspicion the accusation has been levelled and recovery has not been made from the petitioners. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
This Court finds no ground for revising the earlier order. Let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of three weeks from today in connection with Bahadurpur P.S. Case No. 399 of 2015 pending in the court of learned Chief Judicial Magistrate, Darbhanga.
