JUSTICE BIRENDRA KUMAR ORAL ORDER 01-05-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 8(C)/21(B)/27(A)/29 of the N.D.P.S. Act.

Allegation is that 100 gms of heroin like substance was allegedly recovered from the rented house of this petitioner. Submission is that the petitioner has got no criminal antecedent. He is in custody since 04.07.2017. Investigation of the case is already complete. There is noncompliance of mandatory provision of Section 50 of the N.D.P.S. Act. Other house-hold articles including cash and ornaments belong to the newly married daughter of the petitioner, who was

Patna High Court Cr.Misc. No.26100 of 2018 (2) dt.01-05-2018 P2/ also there has been seized.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Ara Nawada P.S. Case No.262 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
